Legal
How we handle data, how we work, and who is behind the name. The short version: your restaurant owns its data and its systems. Everything below spells that out.
[ Template. To be reviewed by legal counsel before publication. ]
Privacy. Your data is yours.
Most software companies treat your data as their asset. We treat it as yours, contractually and architecturally. Everything Qualee builds runs in accounts your restaurant owns; we act as a processor, never as the owner.
Who is responsible
For data collected through this website, [ Qualee legal entity name ] is the data controller within the meaning of Regulation (EU) 2016/679 (GDPR). For the operational data of a client restaurant (reservations, staff schedules, supplier records, guest communications), the restaurant is and remains the controller. Qualee acts solely as a processor under a written data processing agreement (Article 28 GDPR), signed as part of every engagement.
What we collect on this website
When you book a diagnostic or write to us, we collect what you give us: your name, email address, the name of your establishment, and the content of your message. Scheduling runs through our booking provider, which processes your details under its own privacy terms. Beyond that, this site collects only the technical minimum required to serve pages securely; we do not run advertising trackers.
Why we process it
We use your contact details to respond to your enquiry, prepare and run the diagnostic, and, where an engagement follows, to perform the contract (Article 6(1)(b) GDPR). We may keep a record of past correspondence on the basis of our legitimate interest in managing client relationships (Article 6(1)(f)). We do not sell data, share it for marketing, or use client data to train models for anyone else.
Where it lives, and for how long
Data is processed within the European Union wherever possible; where a sub-processor operates outside the EU, transfers rest on an adequacy decision or standard contractual clauses. Enquiry data is kept no longer than needed to handle your request, then for up to [ 24 months ] unless an engagement follows. Client operational data is governed by the data processing agreement: it stays in the restaurant’s own accounts, and when an engagement ends, it stays with the restaurant. The systems keep working without us.
Your rights
Under the GDPR you may request access to your personal data, its rectification or erasure, restriction of processing, data portability, and you may object to processing based on legitimate interest. Write to hello@qualee.ai and we will respond within one month. You also have the right to lodge a complaint with the Luxembourg supervisory authority, the Commission nationale pour la protection des données (CNPD), 15 Boulevard du Jazz, L-4370 Belvaux.
Terms. How we work with you.
Plain terms for a plain relationship: scoped in writing, owned by you, governed by Luxembourg law.
Services
Qualee provides advisory and implementation services for AI and automation systems in hospitality: diagnosis, design, deployment and ongoing optimization. This website is an invitation to talk, not an offer; no engagement exists until both parties sign a written agreement or statement of work.
Engagements
Every engagement is scoped in a written document covering deliverables, timeline, fees and responsibilities. The initial diagnostic call is free of charge and creates no obligation on either side. Systems are built inside accounts and tools owned by the client; on completion or termination, they remain the client’s property.
State co-funding
Qualified digitalisation projects may be co-funded up to 70% (max €17,500) through the SME Packages – Digital (Luxembourg) scheme. This aid is administered and decided by the State via the House of Entrepreneurship, not by Qualee. We scope projects to qualify and help prepare the application, but we cannot guarantee that aid will be granted, and our fees are due independently of the funding decision unless agreed otherwise in writing.
Liability
We perform our services with professional care. To the extent permitted by Luxembourg law, Qualee’s aggregate liability under an engagement is limited to the fees paid for that engagement, and neither party is liable for indirect or consequential loss. Nothing in these terms limits liability that cannot lawfully be limited. [ Final liability wording to be settled with counsel ]
Governing law
These terms and every engagement are governed by the laws of the Grand Duchy of Luxembourg. Any dispute that cannot be resolved amicably falls under the exclusive jurisdiction of the courts of Luxembourg City.
